Commercial law in transition: recent trends and developments
The case of BSkyB v EDS last year highlighted the perils of modern IT work - combined legal costs of over £70m, a claim for £700 and settled on appeal for over £300 - but it is not alone. The end of last year also saw Atos Origin lose its case against De Beers. Commercial law is in transition, moving from the old rules to a more fact-based approach. The judges think it is more "modern" and commercially realistic. It certainly represents a sea-change and businesses need to understand the new legal landscape to avoid unnecessary risk and take advantage of the new possibilities.
