INDEMNIFICATION:

Members agree to indemnify, defend, and hold harmless Vitesse Media, its affiliates and suppliers from any liability, loss, claim and expense (including attorneys' reasonable fees) related to (I) members violation of this Agreement, and (ii) member's posting of material to the site. For all claims relating to Vitesse Media's performance or non-performance, under this agreement, whether in contract, tort, strict liability or otherwise, including without limitation, claims for failure of the program/service to operate, in no event shall Vitesse Media's liability, hereunder, whether arising in contract, strict liability or tort, exceed the fee, if any paid by the member for the program/service.

CHANGES TO VITESSE MEDIA AND THE AGREEMENT:

Vitesse Media may make improvements or changes to the information, services, products, and other materials on the web sites, at any time without notice. Vitesse Media may modify this agreement at any time, and such modifications shall be effective immediately upon posting of the modified agreement. Members agree to review this agreement periodically, and member's continued use of the site shall be deemed acceptance of the modified agreement.

USE OF CONTENT ON VITESSE MEDIA WEBSITES AND PUBLICATIONS:

You may use the program/service and its content only for your personal, non-commercial use. You acknowledge that the program/service contains information, software, advertising and financial market information accessible through the site including without limitation all design, text, audio, images, news, and financial analysis and research and other financial market data as well as photographs, audio, and video clips, graphics, links and other material (collectively the content) that are protected by copyright, trademark or other proprietary rights of Vitesse Media or third parties. All content on the program/service is copyrighted as a collective work of Vitesse Media pursuant to applicable copyright law. You agree to comply with any additional copyright notices, information, or restriction contained in any content available on or accessed through the program/service.

DOWNLOADING:

You may download or copy the content only for your personal use, provided that you retain on such materials the copyright and other notices contained in such content. You shall not store electronically any significant portion of any content. Except as permitted by the copyright laws, no copying, storage, redistribution or publication of any content is permitted without the express permission of Vitesse Media or the owners of such content or their authorized persons, if other than Vitesse Media.

TERMINATION OF PROGRAM/SERVICE:

Vitesse Media reserves the right, in its sole discretion, to restrict, suspend or terminate your access to all or any part of the program/services within their portfolio, including the interactive areas, at any time for any reason without prior notice or liability.Vitesse Media may change, suspend or discontinue all or any aspects of the Program/service at any time including the availability of any feature, database, or content without prior notice or liability

REFUND and CANCELLATION POLICY, AND DELIVERY RELATING TO PAID-FOR SUBSCRIPTIONS

In reference to subscription agreements between Vitesse Media publications and its customers the refund policy is as follows: Customers submitting their details for a subscription to Growth Company Investor, thewrongprice.com or What Investment are agreeing to the following terms surrounding their subscription payments; Each publication takes payment for an annual subscription up-front, after the completion of any agreed trial period. Each publication does not offer pro-rata refunds on subscriptions outside any trial period. Renewal payments are automatic, and are collected on the same date each year. Please be aware of any price rise which may be applicable to the second year of customer subscriptions, and subsequent renewals, which are clearly outlined at the point where customers submit their details. Renewal payments are also annual, and we do not offer pro-rata refunds.

Customers wishing to cancel their subscription must do so within the agreed trial period, otherwise will be liable for the full year's subscription fee which is non-refundable. Similarly with regards to renewal payments, customers must cancel their subscription before the date automatic renewal is taken (annually on the same date each year after the first year's payment), otherwise are liable for the full year's subscription fee which is non-refundable. All customer cancellations received by the subscriptions team will be confirmed in writing. If customers do not receive their cancellation confirmation, they should contact the subscriptions department.

The delivery of paid-for services is through a magazine delivered 10 times per calendar year to the home or work address supplied by the customer, the Growth Company Investor web site (http://www.growthcompany.co.uk) and direct emails. ENTIRE AGREEMENT:

This agreement constitutes the entire and only agreement between Vitesse Media and the customer of Vitesse Media, and supersedes any and all prior or contemporaneous agreement, representations, warranties, and understandings with respect to Vitesse Media, the content, information, goods and services provided by or through Vitesse Media sites, and the subject matter of this agreement.

JURISDICTION:

This agreement and the resolution of any dispute related to this agreement or Vitesse Media shall be governed by and construed in accordance with the laws of England, without giving effect to conflicts of law principles.

Vitesse Media 's failure to insist upon strict enforcement of any provision of this agreement shall not be construed as a waiver of any provision or right. Any legal action or proceeding between Vitesse Media and the customer of Vitesse Media, related to this agreement shall be brought exclusively in the competent jurisdiction of the courts of England.

If at any time the terms and conditions of this agreement are no longer acceptable to you, you should immediately, cease all use of the program/service.

The Directors of Vitesse Media plc accept responsibility for the contents of this website to the extent that they amount to an investment advertisement. The contents contain promotional material for a promotional purpose.

Any provision of this Agreement which is declared void or unenforceable by any competent authority or court shall, to the extent of such invalidity or unenforceability, be deemed severable and shall not affect the other provisions of this Agreement which shall continue unaffected.

PRIVACY POLICY:

The information that you provide about yourself to www.VitesseMedia.co.uk will only be used in accordance with its Privacy Policy. The Privacy Policy does not apply to third party sites.
